BLANC CERISE General Conditions of Sale

This document (General Conditions of Sale) defines the conditions applying to sales made between, as the first party, persons making a purchase via the website Blanc Cerise www.blanc-cerise.co.uk, hereinafter referred to as “the customer” and, as the second party, BLANC CERISE hereinafter referred to as “Blanc Cerise” or "www.blanc-cerise.co.uk" .

These conditions are applicable exclusively to non-commercial natural persons.

They are supplemented by the website’s General Terms of Use, which are mentioned hereinafter.

Definition

These conditions oversee the relationship between Blanc Cerise and the customer. This relationship related to sales on the website www.blanc-cerise.co.uk of various on-line products: home linen (table/bed/bathroom). 

The products and delivery offered on the website are limited to United Kingdom.

This website is edited by BLANC CERISE, a simplified joint-stock company with a capital of 10,000 euros registered on the Nanterre trade and companies register under the number 534673124 RCS, whose head office is at 37 bis rue de Villiers – 92200 Neuilly-sur-seine, APE Code: 4641Z, telephone number: 01 78 66 21 70. This website is accessible 7/7 days.

Orders

The customer can order on the website www.blanc-cerise.co.uk.

The process for ordering is the following:

1. Choose items (size, colour), quantities and add to basket
2. Confirm basket contents
3. Log onto the www.blanc-cerise.com website if the customer is not already logged in (the customer must create an account if they do not already have one)
4. Choose a delivery method
5. Choose a payment method and accept the General Terms and Conditions of Sale
6. Payment is validated (on the CIC Cybermut secure platform)

During the different stages, the customer can view the details of their order and the total amount, then correct any possible errors, before accepting the order through confirmation.

Once this is confirmed, the customer will be sent a confirmation email (detailing the order no. and summary).
The invoice will be available at all times on the website in “My Account”.

Goods remain the property of www.blanc-cerise.co.uk until the order is paid in full, i.e. the receipt of the order cost.

www.blanc-cerise.com reserves the right to cancel or refuse a customer’s order with whom there has been a dispute for a previous order or who behaves in an unusual way.

All orders placed suppose acceptance of the prices and descriptions of products for sale.

The www.blanc-cerise.com website undertakes to honour all orders received via the website only within the limit of available stock.

In the event that the product(s) ordered is/are not available, www.blanc-cerise.com undertakes to inform the customer as quickly as possible and to refund any money that has been paid to www.blanc-cerise.co.uk 30 days following payment of these sums of money at the latest, except if the customer chooses an exchange or a voucher (cf. Exchanges, Returns and Refunds below). The order is then automatically cancelled.

Price of goods

All prices are indicated in pounds, including tax (VAT  19.6%), not including delivery costs (please refer to Delivery).

Prices indicated on the website www.blanc-cerise.co.uk are applicable for a minimum period of 6 months from publication and will not be subject to change during this period.

Articles will be invoiced based on the current prices at the time of the order registration. They remain the property of www.blanc-cerise.co.uk until the order is paid in full to www.blanc-cerise.co.uk.

This price is payable in full and in one instalment.

Payment

Offer limited to United Kingdom.

Payment is made in one instalment.

The website www.blanc-cerise.co.uk offers different methods of payment:

- by credit card: Visa, MasterCard, Carte Bleue
- by Paypal
- with vouchers (cf. Refunds)

This payment is completely secure, directly between the customer and the CIC Cybermut system, with which Blanc Cerise has an electronic payment agreement. This system guarantees a secure payment.

Payment is debited from the customer’s account 2 days after the order is placed. After payment has been validated by the bank, the order is accepted by Blanc Cerise, prepared and dispatched.

www.blanc-cerise.co.uk guarantees confidentiality and security of data transmitted over the Internet and the website www.blanc-cerise.co.uk

For this, the website uses a secure shopping method that uses SSL (Secure Socket Layer) to encrypt any confidential information sent over the Internet. All data is encrypted.

Delivery

www.blanc-cerise.co.uk undertakes to deliver goods ordered and paid for by the customer within 3 to 5 business days (transport time included).

If these goods are not delivered within 7 days from the delivery date advised when the order was placed, and if this is not due to circumstances beyond our reasonable control, the customer can render the sale null by sending a letter by registered post with acknowledgement to the following address:

The sums paid by the customer will then be fully refunded.

Except for sales periods, all orders placed on the website www.blanc-cerise.com before 2 pm on Mondays to Fridays (not including bank holidays) will be prepared and despatched within 2 days, once the payment has been validated (please refer to payment Validation).

The customer undertakes to check the condition of the delivered goods and that they comply with the order: quality, quantity, etc. Any irregularity with goods (discrepancies with the order slip, damaged or open parcels, faulty goods, etc.) must be reported as soon as possible by the customer as soon as they are aware of this.

All goods offered by www.blanc-cerise.co.uk are regulated by legal assurances provided by articles 1641 and following the Civil Code and L.211-4 of the consumer’s Code.

Areas and delivery costs

The customer can choose from the following delivery methods:

- In metropolitan France (not including Corsica):

Colissimo Domicile: £12 or FREE for purchases of £90 and over, estimated delivery time: 3 to 5 business days
UPS Express: £19 for all orders, estimated delivery time: 24 hours (business days) for all orders placed before 1 pm, and 48 hours after 1pm (business days).

The delivery charge is the same regardless of weight.

Blanc Cerise reserves the right to modify these conditions at any time.

Invoice

The invoice is available on the website in “My Account” and can be viewed or printed at any time by the customer. It will be also be sent to the customer by email once the order has been placed. The invoice included in the order reiterates the information provided by the customer in their customer account. The customer can modify these details at any time.

Exchanges, returns and refunds

  1. The time period for returning a product

The customer’s right of retraction is 30 days from reception of the product(s), provided that the conditions and procedure mentioned below have been met.

The cost of returning the product(s) are, where appropriate, paid for by  www.blanc-cerise.co.uk, subject to the conditions defined hereinafter.

The customer can choose between the refund of money paid (in cash or vouchers) or an exchange, subject to the conditions defined hereinafter.

       2. Conditions and returns procedure

The product(s) must be returned in a re-saleable condition to Blanc Cerise, who cannot refuse a return under these conditions. All returns must be processed through the website www.blanc-cerise.co.uk in “My Account”

The return voucher available in “My Account” should be printed and filled out by the customer. The return voucher must be duly completed and enclosed with the return parcel.

 The customer should keep the proof of delivery slip provided by La Poste. In the event that the parcel is lost, no refund will be given without this proof of delivery.

How can the customer return a parcel free of charge?

Blanc Cerise will pay for any returns. For this, the customer should contact Blanc Cerise by email with the following information: order no., an email address to send the post office’s return voucher.

A post office return voucher will be sent by email. This should be used to return the parcel (pre-filled label to be printed and stuck to the parcel).

    3. Returns: conditions and procedure

If the customer chooses to exchange a product(s), they should send an email indicating the following information: order no. and product reference(s), telephone number and address.

In the event of an exchange at a lower cost than the initial purchase, www.blanc-cerise.co.uk will credit the customer’s account on the website with the difference in vouchers (to be used on another order).

In the event of an exchange at a higher cost than the initial purchase, the customer will have to pay the difference by credit card


4. Refunds

Upon reception of the return parcel, www.blanc-cerise.co.uk will, at the request of the customer, issue voucher(s) (available on the website in “My Account”) or a refund within 30 days (from the reception date of the parcel).

Refunds: a confirmation email will be sent to the customer to inform them that their bank account has been credited with the due amount. Refunds are made upon explicit request of the customer. Return refunds are made according to the price of the returned articles, free of any discount applied to the said product(s), and does not include delivery charges, unless the customer has requested a free return by opting for the procedure above.

Voucher: the customer’s personal account on www.blanc-cerise.co.uk will be credited with a voucher for the value of the returned product(s), including any discount on a pro rata basis and not including delivery charges, unless the customer has requested a free return by opting for the procedure above. A confirmation email will be sent mentioning the voucher’s value. The voucher can be used on  www.blanc-cerise.co.uk for a period of one year after the voucher’s issue date. The value of the customer’s vouchers can be viewed at any time on  www.blanc-cerise.co.uk in “My Account”.

** How can the vouchers be used? **

A customer can use their vouchers to pay for part/all of an order. As long as they are valid, the customer can use several vouchers to pay for one order and also use them with any special offer, including during the sales.

Any available vouchers can be seen in “My Account”. An email from www.blanc-cerise.co.uk will be sent to the customer once the voucher has been activated.

The use of any available vouchers will be automatically offered to the customer during order payment.

To pay for part/all of an order with vouchers, the amount will be automatically indicated. The customer must choose the amount they wish to use and validate their choice. The order balance to be paid will then be indicated. The customer can then pay with any of the payment methods accepted by the website.

Vouchers are valid for a period of one year from the issue date.


5. Partial or complete cancellations: conditions and procedure

If the customer wishes to cancel the order before it is dispatched, they should contact www.blanc-cerise.co.uk, within 24 hours of the date of purchase, with the following information:

- The www.blanc-cerise.com order number (this can be found in the confirmation email or in “My Account”/track orders)

- The product(s) in question,

- Customer details (Surname, first name, telephone number, email address) Subject to receipt of this request and the clarifications noted above, www.blanc-cerise.co.uk will proceed with the cancellation and refund of any sums received by the customer from the customer’s bank account, without prejudice to the right of retraction provided above.


6. Gift order

In the event of the customer being sent an order from a third party as a gift, the www.blanc-cerise.co.uk parcel will be sent directly to the customer’s home address. If the customer wishes to exchange the product(s) without going through the third party, they can do this directly through www.blanc-cerise.co.uk. In the case of an exchange or return of a gift order, sent from www.blanc-cerise.co.uk, the customer should contact Blanc Cerise indicating: order no., product(s) reference numbers and personal details.

Responsibility

Products comply with French regulations.

www.blanc-cerise.co.uk is fully responsible to customers for the proper performance of the contract concluded. However, the liability of www.blanc-cerise.co.uk may not be incurred for the non-performance or inadequate performance of the contract concluded in the event of force majeure, the occurrence of an act attributable to the customer or any inconvenience or unforeseen or insurmountable damage inherent to the use of the Internet, in the event of a total breakdown of the service, an external intrusion or the presence of computer viruses.

The site www.blanc-cerise.co.uk contains hypertext links that may lead to other websites. The responsibility of www.blanc-cerise.co.uk may not be incurred for the content of these websites if these infringe current legal and regulatory provisions.

The photographs and illustrations accompanying products on the website give a faithful image of the products on offer. However, very minor variations may not incur the liability of www.blanc-cerise.co.uk and do not affect the validity of the sale.

Customers benefit from a legal guarantee for hidden defects and compliance regarding the products delivered. 

Applicable law

These terms and conditions of sale are governed by French law and comply with current French regulations applicable to sales carried out by electronic means, namely:

·        Act no.78-17 of 6 January 1978 (Data Protection act);

·        Act 2004-575 (Confidence in the Digital Economy act);

·        Act 2008-3 of 3 January 2008 for the development of competition in the interests of consumers.

·        Recommendation no. 07-02 of the Unfair Terms Commission relative to movable goods sales carried out via the Internet.

In the event of a dispute, Blanc Cerise will propose an amicable solution to customers, which they may accept or refuse. In any event, only French courts have jurisdiction.
